Booking terms & conditions
These terms apply to bookings and stays at Cairns Aquarius Holiday Apartments.
1. Booking and payment
The total price will be collected as prepayment before the free cancellation period ends. Accepted payment methods include credit card and bank transfer. Guests are responsible for providing accurate and current booking, contact and payment details.
2. Availability and liability
Cairns Aquarius Holiday Apartments is not liable for loss or inconvenience arising from inaccurate information supplied by a guest or booking agent; facilities temporarily unavailable due to maintenance, technical issues or renovations; an apartment being withdrawn from the rental market; incorrect dates selected by a guest; unsuitable weather; or loss, theft or damage of personal belongings. Nothing in these terms excludes rights that cannot lawfully be excluded under Australian Consumer Law.
3. Special requests
Special requests, including bedding configurations, are subject to availability and cannot be guaranteed. Charges may apply. A request is confirmed only when written confirmation is provided and any applicable payment has been received.
4. Check-in and check-out
Check-in is from 2:00 pm and check-out is by 10:00 am. Early check-in and late check-out must be requested at least seven days before arrival. Requests are subject to availability and confirmation; fees may apply.
5. Occupancy
The stated maximum occupancy must not be exceeded. Additional guests require prior written approval and may incur charges. Apartments are for residential holiday accommodation only.
6. Cancellations and refunds
The guest may cancel free of charge until five days before arrival. If cancelled within five days of arrival, the cost of the first night will be charged. If the guest does not arrive, the full booking amount remains payable. Refunds will be returned to the original payment method where possible. Guests are strongly encouraged to obtain travel insurance.
7. Parties, noise and conduct
Parties, excessive noise and antisocial behaviour are prohibited. Only registered guests may be in an apartment after 10:00 pm. Guests and visitors must comply with body corporate by-laws and reasonable management directions. A serious or repeated breach may result in eviction without refund.
8. House rules
Smoking is prohibited inside apartments and in all common areas, including pool and outdoor areas. Pets are not permitted. Children must be supervised around pools, lifts, common areas, balconies and windows. Glass is prohibited in pool areas. Guests must keep the apartment reasonably clean, dispose of rubbish and recycling in designated areas, wash used dishes and cooking equipment, and immediately report damage, breakages or maintenance issues. Before departure, load dirty dishes into the dishwasher and switch it on. One vehicle may be parked per apartment in the allocated numbered space. Illegal activity and illegal substances are prohibited.
9. Fire alarms
Guests must use exhaust fans where fitted and take reasonable care to prevent cooking smoke from activating a fire alarm. If a guest causes a false alarm, the guest may be charged the applicable Queensland Fire Department attendance fee, currently $1,500 or the amount charged to the property.
10. Damage and security deposits
A security deposit or credit-card authorisation may be required at booking or check-in. Details will be advised before arrival. Guests are responsible for damage, loss, excessive cleaning, unapproved additional guests and other costs caused by a breach of these Terms. Any balance will be released or refunded within a reasonable period after inspection, less properly documented deductions.
11. Additional charges
Reasonable charges may apply for additional cleaning, damage or breakages, lost keys, replacement items, and handling or postage of belongings left behind.
12. Access and inspections
Management or an authorised representative may enter when reasonably necessary for urgent repairs, safety, inspection or a suspected breach, subject to applicable law.
13. Termination
A booking may be terminated without notice for a serious breach. Guests must then vacate immediately and may forfeit accommodation fees, subject to applicable law.
14. Privacy
Personal information may be used to process bookings, manage stays, take payments, communicate, provide support and meet legal obligations. It may be shared with service providers or where required by law. Requests to access or correct information can be emailed to enquiries@cairnsaquarius.com.au.
15. Acceptance
Payment of a deposit or accommodation charge confirms acceptance by the booking guest and all occupants. The booking guest is responsible for ensuring every occupant and visitor complies.
